By registering for a class with International Wine Center (IWC), you acknowledge and agree to the following:
IWC is a consumer-based, private school dedicated to teaching individual consumers about wine for their personal and private enjoyment. IWC does not provide instruction to prepare you for an occupation or career involving wine, or any other occupation or career. Accordingly, you understand that the courses offered by IWC are recreational and are not intended to result in the acquisition of occupational skills.
Nothing in IWC's advertising and/or promotional materials and/or course materials, including information contained on IWC's website, is intended to convey anything contrary to the above.You recognize that IWCs use of academic terms such as certificate, course, and diploma are intended to convey the expert level of instruction that IWC provides all of its students and is not, in any way, intended to give the impression that IWC is authorized or permitted to confer a degree, license, or any other credential recognized by any licensing agency within the state of New York.
IWC uses WSET course materials in its instruction. You understand that WSET qualifications are part of the UK qualifications framework and are not part of any regulated qualifications framework outside UK. By enrolling in a course at IWC, you are entitled to sit for the corresponding WSET examination within 12 months of the start date for which you registered. If you choose not take the examination in that time period, you may take the examination at a later date. You will, however, be required to pay a fee of an amount to be assessed as of the actual date of the examination.If, for whatever reason, you need to cancel your place in an in-class course or an online course before the course begins, you understand that you will receive a refund of the class fee, less a 10% cancellation fee. If IWC has sent a materials kit to you, you must return that kit to IWC, complete and unused, to receive credit. Registration and shipping fees are not refundable.You understand that if you cancel after an in-class or an online course begins, no refunds apply. Certain qualifications may apply.
Enforceability and Governing Law
If any of the terms or provisions of these Terms and Conditions is held by a court to be unenforceable, the remaining terms and provisions will remain in force. The unenforceable term or provision will be replaced by an enforceable term or provision that comes closest to the intention underlying the unenforceable term or provision. These Terms and Conditions are subject to all agreements you have entered with International Wine Center. The terms of this disclaimer are governed by the laws of the State of New York.
Any action against IWC arising from the provisions of these Terms and Conditions must be brought by you in state or federal court located in the State of New York, County of New York. You consent to the jurisdiction and venue of the state and federal courts located within State of New York, County of New York, for the adjudication of all claims by IWC against you arising from or relating to the provisions of these Terms and Conditions.
IWC is not liable for any direct, indirect, special, incidental, or consequential damages that you may incur by relying upon information conveyed about or by IWC or WSET. This includes, for example, lost profits, lost business, or loss of business opportunity.To the fullest extent permitted by law, the total liability, in the aggregate, of IWC and anyone acting on behalf of IWC (including its sub-contractors), to you and/or anyone making a claim on your behalf, is limited to the enrollment fee you paid to attend the course from which your alleged claim or claims arise. This includes any claim for attorneys' fees and costs and expert witness fees and costs.
